What Nevada has done
Nevada is one of 7 states in active legal dispute with prediction-market operators over whether a federal CFTC designation displaces state gambling law. The Nevada Gaming Control Board has issued a cease-and-desist to prediction-market operators, and that dispute is now in litigation.
Nevada has the strongest institutional interest of any state in defending its licensing regime, and is one of the seven states in active dispute with prediction-market operators.
The state's argument is that offering event contracts on sporting and political outcomes to Nevada residents is gambling under state law, regardless of what the contracts are called federally. The operators' and the CFTC's argument is set out below.

The federal picture, briefly
Polymarket US lists event contracts on QCX LLC, a CFTC-designated contract market (DCM) with affiliated derivatives clearing organization (DCO). Polymarket acquired that licence by buying QCEX for $112 million in July 2025, reopened to US traders on 2 December 2025, and removed the iOS waitlist on 12 May 2026.
Operators and the CFTC argue the Commodity Exchange Act gives the CFTC exclusive jurisdiction over federally designated contract markets, pre-empting state gambling statutes. Several district courts have accepted that argument at the preliminary-injunction stage. No final appellate resolution as of August 2026.
Roughly roughly 43 of 50 states currently offer full-menu access to CFTC-regulated prediction markets.
Why this matters in Nevada
Nevada has legal online sportsbooks. Because the state already collects tax from licensed operators, it has a direct financial interest in how event contracts are treated — which is a large part of why the licensed-market states have been the most active on this issue.
